Abstract: La desobediencia civil es una figura de amplia repercusión en el plano social, cuya esencia
reside en promover el incumplimiento de una ley por medio de vías pacíficas, con la
finalidad de restaurar la legitimidad del orden constitucional. El presente trabajo expone
las razones que se han esgrimido alrededor de su construcción conceptual, tomando en
consideración los incipientes estudios de Thoreau, a partir de un episodio personal, así
como las tesis de Tolstoi y Gandhi, quienes han contribuido a otorgarle un cariz más
amplio y complejo al punto de promover eventos colectivos de resonante impacto social.
Tales expresiones a su vez han suscitado la atención de conspicuos teóricos
contemporáneos como Rawls, Dworkin o Habermas, cuyas ideas han afianzado la
necesidad de comprender a la desobediencia civil como un fenómeno en perfecta
correspondencia con el ordenamiento jurídico dentro de un Estado Constitucional de
Derecho. Cabe mencionar que la presente investigación es de tipo dogmática propositiva y
ha sido realizada de acuerdo a un enfoque cualitativo documental, en virtud del cual se ha
determinado que la figura tiene todas las características para ser considerada un derecho
constitucional de aplicación inmediata en el sistema jurídico peruano.
Civil disobedience is a figure of wide repercussion in the social sphere, whose essence lies in promoting the breach of a law through peaceful means, in order to restore the legitimacy of the constitutional order. The present work exposes the reasons that have been put forward around its conceptual construction, taking into consideration the incipient studies of Thoreau, from a personal episode, as well as the theses of Tolstoy and Gandhi, who have contributed to giving it a broader look and complex to the point of promoting collective events with a resounding social impact. Such expressions in turn have attracted the attention of conspicuous contemporary theorists such as Rawls, Dworkin or Habermas, whose ideas have strengthened the need to understand civil disobedience as a phenomenon in perfect correspondence with the legal system within a Constitutional State of Law. It is worth mentioning that the present investigation is of a proactive dogmatic type and has been carried out according to a qualitative documentary approach, by virtue of which it has been determined that the figure has all the characteristics to be considered a constitutional right of immediate application in the peruvian legal system.
