The present investigation "Analysis of the normative element "should presume" in the criminalization of the crime of reception in the Peruvian Penal Code", had the objective of determining to what extent the normative cognitive element of the type "should presume" configures the crime of reception in the Peruvian Penal Code. For this, a study with a qualitative approach, dogmatic type, explanatory legal level was used. The study unit was made up of a prosecutor and three specialist lawyers, also cases (appeals on the crime of reception). The techniques and instruments used were the analysis of theories, matching and interviews (interview guide). The results were, for the configuration of the crime of reception in this case, the author does not know that the goods are of criminal origin, but "had to presume" that they were. The law prescribes that the citizen has the "duty" to presume and, as long as he violates his duty as a citizen, he is criminally responsible. Therefore, it is concluded that the normative cognitive element of the type "should presume" configures the crime of reception solely by way of fraud from a normative perspective. In accordance with the legal guidelines of Criminal charges, it covers several aspects (dogmatic and procedural) to be taken into account, since, on the one hand, there are the criteria or filters of "objective charge" and "subjective charge", on the other hand, on the other hand, it is established as a "procedural principle" (necessary imputation).
