The present study is entitled "Socio-legal factors that justify so that heterological insemination without the consent of the spouse is considered as a cause of divorce in the civil code (1984)" which has as main objective to determine the socio-legal factors that justify for that heterologous insemination not consented to by the spouse is considered as grounds for divorce in the Civil Code (1984). For this, a purely qualitative, descriptive and purposeful methodology was applied, the study unit was made up of the doctrinal and legislative information inherent in the national context in order to demonstrate that the lack of acceptance must be grounds for divorce; The data collection technique applied was the analysis of institutions such as the family, marriage, divorce and assisted reproduction techniques. And the normative exegetical analysis, and the applied instrument was the doctrinal and normative analysis sheet. As a result, he obtained that within today's society science has been advancing very quickly and law as a science has also evolved; However, the laws and norms that regulate social coexistence do not have the same progress and development, so we have the case of the consequences and legal effects of heterologous artificial insemination where one of the spouses has not given their acceptance for the indicated artificial propagation. Therefore, it is concluded that it is necessary and urgent that the Civil Code include one more cause for the case of divorce, since there is no national norm that regulates it.
