The objective of this study was to describe the violation of the fundamental right to access to drinking water of the population of Accha Siwina de Paruro in the Cusco Region, 2020. The methodology used was descriptive in scope, qualitative approach since the information acquired is not numerical, on the other hand, it was appreciated that the design used was non-experimental and that no intentional changes were made to the variable for modification, likewise the sample was of 14 interviewees between community members and community authorities. The results show that there is a violation of the rights of access to drinking water for human consumption, since the water administrator of the municipality of Accha is involved in excessive abuses and water cuts, which is a crime since this mention is contextualized in jurisdictional bodies that protect water. In conclusion, although water is recognized as a fundamental right both by the Peruvian state in the Constitution of Peru in Article 7-A, and by the United Nations, there are still entire Peruvian districts that do not enjoy this right, as is the case of the inhabitants of the district of Accha Siwina, it does not only mean mere access to water, its content is more extensive and includes a series of obligations that every member state of the Covenant on Economic, Social and Cultural Rights must fulfill. For this reason, the Peruvian state is in flagrancy with its own inhabitants and should take measures to counteract this situation.
