Abstract: El problema de la alienación parental requiere de un estudio integral con los derechos
de los niños y de los adolescentes prescritos en nuestra Constitución Política del Perú y en
los tratados de derechos humanos. Ésta problemática debe ser prioridad del Estado y de la
sociedad.
En la práctica del derecho de familia se discute casos de tenencia de niños y
adolescentes que obligan a los operadores del derecho buscar criterios de solución al
problema del síndrome de alienación parental. Considero que no se tienen criterios claros y
concretos sobre esta problemática. Ello revela la importancia que viene adquiriendo el
estudio de este problema, lo que lleva a desarrollar la presente tesis, a fin de que los
operadores del derecho cuenten con herramientas técnicas para identificar si estamos o no
ante un supuesto síndrome de Alienación Parental.
Esta problemática surge en los procesos de tenencia en los que se discute quien de los
padres cuidará de los hijos, por lo que el diagnóstico requiere de criterios objetivos a fin de
evitar arbitrariedades y subjetivismo a la hora de decidir, puesto que de este modo se
garantizará el principio de interés superior de los niños y adolescentes.
Consecuentes con lo afirmado anteriormente, es claro que el síndrome de alienación
parental necesita de un estudio con profundidad que permita orientar a los jueces y
tribunales en la resolución de los casos que se les presentan. Por lo que en el presente
trabajo de investigación se hará un tratamiento de este problema con el análisis respectivo.
The problem of parental alienation requires a comprehensive study of the rights of children and adolescents prescribed in our Political Constitution of Peru and in human rights treaties. This problem must be a priority of the State and of society. In the practice of family law, cases of tenure of children and adolescents are discussed, which oblige the rights operators to seek criteria for solving the problem of parental alienation syndrome. I believe that there are no clear and concrete criteria on this problem. This reveals the importance that the study of this problem has acquired, which leads to the development of the present thesis, so that the operators of law have technical tools to identify whether or not we are facing a supposed syndrome of Parental Alienation. This problem arises in tenure processes in which it is discussed who of the parents will take care of the children, so the diagnosis requires objective criteria in order to avoid arbitrariness and subjectivism when deciding, since in this way will guarantee the principle of best interests of children and adolescents. Consistent with the aforementioned, it is clear that the parental alienation syndrome requires a thorough study that allows the judges and courts to be guided in the resolution of the cases presented to them. Therefore, in the present research work will be a treatment of this problem with the respective analysis.
