The present research work is referred to the ex officio evidence, because our criminal procedure code is the beacon that guides a system respectful of the constitutional principles and the guarantees postulates housed by our Political Constitution, however, it can be notice that the code itself retains some lags of the system that is intended to leave, because we find traces of the agonizing inquisitive model, waste that jeopardize the full force of the accusatory model and, in addition, undermine its essence, as is to provide proof ex officio. The present investigation intends by means of the legal argumentation, to repeal the proof ex officio of our Code of Criminal Procedure, exactly in articles 155.3 and 385 clauses 1 and 2 of the new one, and for which we will construct a legislative proposal with reasonable arguments and also supported with positions in that sense within the legal community. The first chapter of the present investigation is related to the problem and the methodological aspects of the study that has been used to arrive at our conclusions. In the second chapter we deal with the background of the investigation and the theoretical basis of the present investigation, and the third chapter is referred to the results and discussion to finally consign the conclusions and recommendations; and, to arrive at said conclusions in the development of the present investigation methodologically, it has been carried out within the qualitative and proactive approach.
