Aplicación de la vigilancia electrónica como medida de protección en la Ley para prevenir, sancionar y erradicar la violencia contra las mujeres y los integrantes del grupo familiar - Perú

Abstract

La presente investigación, tiene como fin coadyuvar con la justicia, previniendo los altos índices de violencia familiar contra la mujer y los integrantes del grupo familiar, cometidos por agresores (pueden ser su pareja, cónyuge, enamorado o cualquier relación de “inter alia”, en un contexto de confianza), en contra de la mujer o cualquier integrante del grupo familiar, por lo que el trabajo de investigación es de aplicación teórico, con un ámbito a nivel nacional, donde se propone aplicar la vigilancia electrónica en agresores para monitorear sus pasos, y así no se pueda acercar a la víctima de violencia familiar, cuando se imponga medidas de protección y alejamiento, en casos de riesgo severo, por lo que la presente investigación contiene la siguiente estructura: El primer capítulo: constituye la parte introductoria, el planteamiento del problema, la justificación y los objetivos de investigación y delimitación de estudios. El segundo capítulo: Antecedentes de estudio, Bases teóricas, Marco Conceptual, Hipótesis de trabajo y Categorías de estudio. El tercer capítulo: Diseño metodológico, Diseño contextual y Técnicas e instrumentos de recolección de datos. El cuarto capitulo: Violencia Familiar en Contra de las Mujeres e Integrantes del Grupo Familiar y La vigilancia electrónica personal. Y finalmente el quinto capitulo: Resultados del estudio, Análisis de los hallazgos , Discusión y contrastación teórica de los hallazgos, Conclusiones, Recomendaciones o sugerencias, Referencias bibliográficas y Anexos.

The purpose of this research is to contribute to justice, preventing high rates of family violence against women and members of the family group, committed by aggressors (they can be their partner, spouse, boyfriend or any relationship "inter alia", in a context of trust), against the woman or any member of the family group, for which the research work is of theoretical application, with a scope at the national level, where it is proposed to apply electronic surveillance in aggressors to monitor their steps, and thus the victim of family violence cannot be approached, when protection and removal measures are imposed, in cases of severe risk, for which the present investigation contains the following structure: The first chapter: constitutes the introductory part, the approach of the problem, the justification and the objectives of investigation and delimitation of studies. The second chapter: Study Background, Theoretical Bases, Conceptual Framework, Working Hypotheses and Study Categories. The third chapter: Methodological Design, Contextual Design and Data Collection Techniques and Instruments. The fourth chapter: Family Violence Against Women and Members of the Family Group and Personal Electronic Surveillance. And finally the fifth chapter: Results of the study, Analysis of the findings, Discussion and theoretical comparison of the findings, Conclusions, Recommendations or suggestions, Bibliographic references and Annexes.
