This research addresses the problem of the consequences arising from the creation of a mortgage levy on co-ownership by a co-owner over its ideal share, this in the wake of the second precedent of the Seventeenth Plenary of the Registration Court, which causes non- mortgage co-owners of their ideal shares to be affected in their separate departures from a division and partition with the entry of this levy, The right to own property is violated and the exploitation thereof is undermined. For these effects, the methodological design of a qualitative approach with an exploratory or analytical dogmatic research design was used. Thus, according to the main objective, a mechanism was sought to analyze and put into context a real legal situation. This enabled the details and scope of the legal reasons for the problem to be identified and known, finding the lack of protection in which non-mortgage co-owners have fallen from their ideal quotas in their independent departures from a division and partition. In addition, at the end of this work, it is recommended that SUNARP inform the Ministry of Justice of this problem, so that a study can propose a legislative initiative to adopt the declaratory theory, which would allow the co-owners not to be affected by their registration items.
