Identidad dinámica en los procesos de filiación en relación al principio del interés superior del niño en el juzgado de familia de La Convención, Cusco, 2018-2019

Abstract

La presente investigación titulada “IDENTIDAD DINÁMICA EN LOS PROCESOS DE FILIACIÓN EN RELACIÓN AL PRINCIPIO DEL INTERÉS SUPERIOR DEL NIÑO EN EL JUZGADO DE FAMILIA DE LA CONVENCIÓN DEL CUSCO, 2018-2019”, tiene por objetivo general “Conocer y analizar de qué manera se trató el instituto jurídico de la Identidad Dinámica en los procesos judiciales de filiación, en relación al principio del Interés Superior del Niño en el Juzgado de Familia de la Convención, del Cusco en los años, 2018 – 2019”.

Los objetivos específicos están referidos al análisis del contenido y alcances del instituto jurídico de la Identidad Dinámica en relación al principio del Interés Superior del Niño y cómo debe aplicarse en los procesos de filiación.

La investigación posee un enfoque cualitativo documental de tipo jurídico descriptivo, las técnicas de recolección de información, fueron análisis documental y entrevistas.

Se postuló como hipótesis general, “El tratamiento del instituto jurídico de la identidad dinámica en los procesos judiciales de filiación en el Juzgado de Familia de La Convención, Cusco, 2018 – 2019, probablemente se no tomó en cuenta el principio del Interés Superior del Niño en toda su dimensión”.

La discusión de los resultados se realizó a través de la argumentación jurídica.

Las hipótesis fueron validadas y la principal conclusión es, “El tratamiento judicial del instituto jurídico de la identidad dinámica en los procesos de filiación en el Juzgado de Familia de La Convención, Cusco, no tomó en cuenta el principio del Interés Superior del Niño en toda su dimensión”.

The present research entitled “DYNAMIC IDENTITY IN THE FILIATION PROCESSES IN RELATION TO THE PRINCIPLE OF THE CHILD'S BEST INTEREST IN THE FAMILY COURT OF THE PROVINCE OF LA CONVENCIÓN, CUSCO, 2018-2019“, has the general objective of “Knowing and analyzing what This way, the legal institute of Dynamic Identity was treated judicially in the filiation processes, in relation to the principle of the Best Interest of the Child in the Family Court of the Province of the Convention, Cusco, 2018 - 2019 ”.

The research has a qualitative documentary approach of a descriptive legal type, the techniques of information collection were documentary, analysis and interviews. It was postulated as a general hypothesis, “The judicial treatment of the legal institute of dynamic identity in filiation processes in the Family Court of La Convención, Cusco, 2018 - 2019, probably did not take into account the principle of the Best Interest of the Child in all its dimension”.

The discussion of the results was carried out through legal argumentation The hypotheses were validated and the main conclusion is, “The judicial treatment of the legal institute of dynamic identity in the filiation processes in the Family Court of La Convención, Cusco, did not take into account the principle of the Best Interest of the Child in all its size.
