The problem covered by this investigation is related to the regulation of the Legitimate, the Quota of Free Availability and the Intangibility of the legitimacy in our current Civil Code, through which it is established that the testator can only freely dispose via testamentary and state his will on a third of its assets, which leads us to consider whether or not such regulation violates the right that assists every owner to freely dispose of their property, having the possibility of taxing it, disposing of it, donating it; That incidentally, also for acts free of charge such as donation there is this restriction; However, we believe that the application of these articles and the impact on property rights deserve a full analysis, in order to broaden our knowledge, raise conclusions and recommendations in this regard, a possible reform would bring a new time for succession in general and for the specific testamentary succession, it would be interesting to study the effects that it would entail, if this would improve the almost zero testamentary culture in our country, and the population's response to such change. Of course, we are not going to make a modification or reform, since it is up to the legislators and the commission responsible for the reform of the Civil Code to raise it properly for its subsequent approval and promulgation; However, if we seek to analyze and fully understand the institution of the Legitimate, The Wills, the Succession in General and the Property Law. In order to expand our knowledge and achieve a complete vision in this regard.
