The present study has as general objective to identify how they affect the deficiencies that exist in the Law of State Contracts in the stage of contractual execution in works by means of public licitation in the Regional Government of Cusco during the period 2016. The study includes the hypothesis that these deficiencies affect significantly in the stage of contractual execution in works through public bidding in the Regional Government of Cusco, causing the commission of crimes by public officials in charge of contracting this due to lack of efficient regulation of the Law on State Contracting, especially in the subject of supervision of works by the entities. In addition, such deficiencies result in the commission of acts of corruption by the officials in charge, higher costs at the end of the works and in some cases because of the lack of supervision and control, they cause poorly executed works. And that the actions of the representatives of the Regional Government, in the stage of contractual implementation infers in the compliance with the regulations on contracting with the State, because they do not have an in-depth knowledge on state contracting. Likewise, its actions are aimed at self-satisfaction and of third parties, but not at the fulfillment of the public purpose. For the field work, it was carried out with a sample of 10 resolutions contained in the file of liquidation of works of the Regional Infrastructure Management. As well as the surveys conducted to officials of the Regional Government of Cusco. The study will serve as a basis for other researchers to continue to deepen the subject, as a basis for proposals to achieve adequate control and transparency in public procurement, and thereby improve efficiency, effectiveness, economy and ensure compliance with the goals institutions in the Regional Governments for the public purpose.
