The purpose of this research work entitled “Analysis of the action protocols in the use of public force in social protests in Peru December 2022 and February 2023” was to analyze the action protocols for the use of force by the PNP in the framework of the social protests that occurred in December 2022 and February 2023, taking a look at the legal dogmatics, international law and internal regulatory framework, in order to determine the legal and theoretical aspects of the use of force, for which which has established the use of a qualitative study method through a documentary analysis sheet, however, it can be seen that the levels of the use of force are expressly contemplated in the internal regulations that are based on international law. Taking into account the theoretical and legal aspects and the results of the study we reach the following conclusions: The action protocols in the use of force by the Police are clearly established by Legislative Decree No. 1186 and its Regulations, the Human Rights Manual applied to the police function, which are based on international standards, which means that they must act based on the principles of proportionality, necessity and legality. The massive social demonstrations of national scope exceed the scope of control of those in charge of maintaining public order, consequently the specialized Police personnel to control the protests is insufficient; Therefore, the command turns to police personnel from other specialties that have a lower level of training and instruction on the subject of control of social protests. This would lead to inappropriate application of action protocols in the use of force by police personnel from other specialties.
