The urban transport service in the city of Cusco is provided in the form of concession of routes product of a general bidding process carried out by the provincial municipal administration in 2014 by which the respective contracts that establish the rights and obligations were signed of the parties involved in order to generate a quality service for the user; The fulfillment of the subscribed clauses constitutes the guarantee that relates sustainability with the quality of the service, in this context the present investigation had as objective to describe if these are adequately fulfilled by the intervening parties either in condition of service operators or as delegated administrator by law for which the study and analysis carried out on the company Multiservicio Rápido Sociedad Anonima in the condition of operator of the urban transport route 16 is approached; the type of investigation is of the applied type was that corresponding to a basic type investigation, with a focus quantitative non-experimental design and descriptive scope; Work was carried out on the entire population constituted by the company under study and the thirty-six partners or owners of the vehicle units put into service; It is concluded that the company does not adequately fulfill the contractual obligations related to different clauses, being firstly those working with the workers who participate in the provision of the service presenting alarming levels of informality; Breaches of obligations related to the conditions of administration of the service by having outsourced it through its partners, inadequate business management was evidenced by not having adequate accounting and financial information for decision- making, the company becoming a vehicle unit affiliate. That directly affects the quality; it also determines an inadequate compliance with tax obligations that affect the state by becoming offenders whose breach should be sanctioned as established by the tax code and creates conditions for the termination of the concession contract. Consequently, it is determined that the municipal administration has limited its actions to maintain the existence of the service without legally requiring the proper fulfillment of the signed contract, which affects the conditions of quality of the service to the detriment of the users.
