It is widely known that over time Labor Law has suffered from a continuous evolution, having developed a varied range of disintegrants in each aspect that has its range of application, a clear example of this is observed in the different Labor Regimes that our The legal system currently provides us, with the labor regime of the Public activity, the regime of the Private Activity, the Special regime of the Administrative Contracting of Services, Civil Construction Regime, among others. By having a wide range of regulations applicable to each working condition, a more accurate approach to the type of contract to be signed with a worker can be developed, this simplifies the work of the employer and provides legal certainty for both. However, as is proper to the law, there will always be circumstances where the regulatory sphere can not clarify a particular fact and in this case is what happened with the workers belonging to Municipalities and Regional Governments, since they have gone through various labor regimes, taking that to emit until a Casatory Sentence to be able to give a greater precision of the corresponding regime, arriving at the conclusion that these workers belong to the Labor Regime of the Private Activity. However, currently there are problems in public entities, such as the Special Regional Project COPESCO Plan, which is an executing unit of the Regional Government of Cusco, which currently has divergences in relation to judicial repossessions. its workers, this is due to the hiring under the Civil Construction Regime, not applying the Labor Regime of the Private Activity regulated by Legislative Decree No. 728
