La despenalización del aborto sentimental por violación sexual para salvaguardar la dignidad y libertad de la mujer

Abstract

La violación sexual es un delito que constituye gran preocupación en el Perú por sus alarmantes estadísticas, delito que afecta a mujeres y menores de edad en la mayoría de los casos, originando embarazos no deseados en las victimas. El propósito de esta investigación ha sido analizar si la despenalización del aborto sentimental por violación sexual, puede contribuir a salvaguardar la dignidad y libertad de la mujer víctima de este acto sexual delictivo. Para tal objetivo se ha seguido un diseño metodológico que corresponde a la dogmática exploratoria. Como resultado se ha podido establecer que este delito afecta a la dignidad y libertad de la mujer victima y que la despenalización del aborto por esta causal contribuirá efectivamente a reivindicar la dignidad y libertad afectada por el hecho violento. Se ha formulado una propuesta legislativa que busca modificar el articulo 120 del Código Penal Peruano para hacer posible disminuir los efectos negativos que afectan a las mujeres víctimas de violación sexual y que se ven obligadas a llevar adelante un embarazo no deseado.

Rape is a crime that is a major concern in Perú because of its alarming statistics, a crime that affects women and minors in most cases, causing unwanted pregnancies in the victims. The purpose of this research has been to analyze whether the decriminalization of sentimental abortion for rape can contribute to safeguarding the dignity and freedom of the woman victim of this criminal sexual act. For this objective, a methodological design has been followed that corresponds to exploratory dogmatics. As a result, it has been established that this crime affects the dignity and freedom of the woman victim and that the decriminalization of abortion on this ground will effectively contribute to vindicating the dignity and freedom affected by the violent act. A legislative proposal has been formulated to amend article 120 of the Peruvian Penal Code in order to make it possible to reduce the negative effects affecting women victims of rape who are forced to carry out an unwanted pregnancy.
