The present thesis carried out the study and description of the right to sexual indemnity, to describe and understand sexual indemnity, for which the following question was posed, How is the right to sexual indemnity of minors, in the perspective of prosecutors and judges of the district of Santa Ana province of the convention department of Cusco in the year 2020, therefore as a general objective it was proposed to describe the right to sexual indemnity of minors, in the perspective of prosecutors and judges of the district of Santa Ana province of the convention department of Cusco in the year 2020. In the methodology, we used the approach that comes to be qualitative, the type of research is descriptive, where we describe the category that is sexual indemnity and its subcategories sexual development and state guardianship; the study population is made up of 18 prosecutors and 8 judges of the province of La Convención, in the technique we used the written and virtual interview, and in the instrument a Guide of Questions. A non- experimental phenomenological design was applied, with the participation of 8 judges and 6 prosecutors, for which a question guide was used as an instrument that was filled out according to the answers given by the interviewees. The results show that the "right to sexual indemnity" is presented as a fundamental right inherent to minors and recognized as the protected legal right of minors under 14 years of age, which protects the sexual integrity of minors and incapable persons, since they lack the physical and psychological maturity to exercise their will or make decisions to consent to sexual acts.
