In this research, the sincere effectiveness of Legislative Decree No. 1384 was analyzed, since being an active norm implies the recognition of the favorable legal capacity not only for people with disabilities but in a general way, that is, the free disposition of the legal capacity of people in equal conditions, however, the present problem arises from not being interpreted or applied correctly by Notaries, specifically when it comes to people over 75 years of age, that is, when an adult person requests before a Notary a public instrument such as the Public Deed, in addition to the general requirements they are required a mental health certificate, despite not being regulated in the Law of Notaries. Although this law states that notaries must verify the identity of grantors and may request documents of their own choosing, the law does not specifically require a mental health certificate; Therefore, it is a discriminatory act to require this mental certificate to people over 75 years of age to hire, because age does not necessarily mean the deterioration of the capacity to make decisions, much less express them according to law. This research focused on the theoretical bases related to legal capacity, mental, psychological and psychiatric health, the granting of public instruments and Legislative Decree No. 1384. A qualitative approach methodology was used with an exploratory or analytical dogmatic research design that included surveys with specialists in the field. What allowed to find as a result, the ineffectiveness of Legislative Decree No. 1384 due to the lack of application of said regulations by the Notaries of the city of Cusco, which harms the right of free legal capacity of people over 75 years. Therefore, it is necessary to create legal instruments and frameworks that help protect older adults in these situations.
