Our research initially includes the methodological aspects of the study, where it can be determined that within the formalization process that took place in the country, there were a series of modifications in the formalization regulations that generated a complex formalization process, raising the question whether the Declaration of commitment has the value of an administrative act and that its registration in REINFO could be considered as an authorization to operate. Therefore, in our investigation, the intention is to determine if the declaration of commitment and the registration in REINFO are considered as administrative acts that allow the start of activities in small mining, as well as to determine what effects an administrative act produces in the process of formalization of mining activity, likewise it will be determined that it is a declaration of commitment and that it is the Integral Registry of Mining Formalization and what are its effects within the formalization process, for which an exhaustive analysis of the legislation was carried out In mining in order to determine what is the procedure to access a right to use non-renewable resources, a legal and dogmatic analysis of the administrative act was also carried out. This research presents a methodological design with a qualitative approach using non-experimental research. It was possible to determine that the declaration of commitment and the registration in REINFO are not considered administrative acts because they do not comply with the conditions provided by law, although these documents are not administrative acts, but they do allow them to be carry out the mining exploitation activity.
