Creación de un sistema de intermediación digital – Sid Consular, como un medio de fortalecimiento de la seguridad jurídica en el Perú

Abstract

La presente investigación fue intitulada “Creación de un Sistema de Intermediación Digital – SID consular, como un medio de fortalecimiento de la seguridad jurídica en el Perú”. La función consular es desconocida por la mayoría de personas, no obstante, esta es de gran relevancia para nuestra seguridad jurídica puesto que muchos de los documentos realizados por los cónsules ingresan a los registros públicos; en consecuencia, se requiere tener un sistema digital que permita una comunicación entre los funcionarios consulares y los registradores públicos evitando que haya casos de falsificación y suplantación de identidad. Es por ello que se planteó como objetivos establecer la razones que fundamenten la incorporación del SID consular y las implicancias que tendrá este en nuestro sistema registral. Para ello se optó por un enfoque cualitativo con un nivel descriptivo analítico. Del trabajo se puede colegir que existen casos de falsificación de escrituras públicas consulares que fueron inscritos en la Sunarp, vulnerando nuestro sistema y por ende la seguridad jurídica; en tal sentido se evidencia la necesidad imperante de contar con un sistema digital denominado SID- Consular que permitirá la presentación digital de los partes consulares dotando de mayor seguridad jurídica a nuestro sistema, así como el ahorro de tiempo y dinero para los usuarios.

This research was titled “Creation of a Digital Intermediation System – Consular SID, as a means of strengthening legal security in Peru.” The consular function is unknown to most people, however, it is of great relevance for our legal security since many of the documents made by consuls enter public registries; Consequently, it is necessary to have a digital system that allows communication between consular officials and public registrars, preventing cases of falsification and identity theft. That is why the objectives were set to establish the reasons that support the incorporation of the consular SID and the implications that this will have on our registration system. For this, a qualitative approach with a descriptive analytical level was chosen. From the work it can be deduced that there are cases of falsification of consular public deeds that were registered in Sunarp, violating our system and therefore legal security; In this sense, the prevailing need to have a digital system called SID-Consular is evident, which will allow the digital presentation of consular reports, providing greater legal security to our system, as well as saving time and money for users.
