El sistema AFIS policial y la identificación del autor en el delito de hurto en el tercer despacho de investigación de la Segunda Fiscalía Provincial Penal Corporativa de Cusco entre los años 2016 - 2018

Abstract

La presente investigación trata sobre el funcionamiento del Sistema AFIS Policial en la identificación del autor del delito de hurto cuando se tienen huellas dactilares aprovechables. Teniendo en cuenta que la identificación del sujeto activo es el elemento más importante a efecto de poder continuar con el proceso de investigación, mediante su formalización. Ahora bien, es una realidad que nuestro país tiene una alta tasa de criminalidad, siendo de suma importancia poder combatirla mediante un proceso de investigación eficiente; considerando además que, el sentimiento de impunidad se ha generalizado en la población; ya que, asumen que no vale la pena denunciar cuando se es víctima de un delito, porque consideran que no lograrán obtener justicia; sino que, al contrario, perderán tiempo y dinero. En ese sentido, hemos planteado como objetivo general: determinar si el Sistema AFIS Policial cumple con la función de identificar a los autores del delito de hurto en el Tercer Despacho de Investigación de la Segunda Fiscalía Provincial Penal Corporativa de Cusco entre los años 2016-2018. Es así que, hemos utilizado técnicas e instrumentos de investigación aplicados al personal fiscal y a las carpetas fiscales. Asimismo, se ha obtenido información (procedimientos, estadísticas, data) de instituciones tales como el Ministerio Público, el INEI y de las distintas dependencias del Ministerio del Interior. Finalmente, se ha concluido en que el Sistema de Identificación Dactilar AFIS Policial no cumple con la función de identificar al autor del delito de hurto en el despacho y periodo de tiempo en mención. Motivo por el cual, explicamos tanto la importancia como la necesidad de contar con una base de datos de huellas dactilares actualizada y suficiente.

This research is about the functioning of the Automated Biometric Identification System in the process of identification of the perpetrator of theft, when exists usable fingerprints. Considering that, the result of that process is the most important element in order to keep on with the criminal investigation. Now, it´s a reality that Peru has a high crime rate, being of utmost importance to combat it through an efficient investigation process. Considering that, the feeling of impunity has become widespread in the population, since they assume that it is not worth reporting when they are victims of crime, because they believe they will not get justice; but on the contrary, they will lose time and money. In that sense, we have set as a general objective: to determine whether the Police AFIS System fulfills the function of identifying the perpetrators of the crime of theft in the Third Investigation Office of the Second Corporate Provincial Criminal Prosecutor's Office of Cusco between the years 2016-2018. Thus, we have used investigative techniques and instruments applied to the prosecutorial staff and to the prosecutorial folders. Likewise, information (procedures, statistics, and data) has been obtained from institutions such as the Public Prosecutor's Office, INEI and from the different departments of the Ministry of the Interior. Finally, it has been concluded that the Police Fingerprint Identification System - AFIS does not fulfill the function of identifying the perpetrator of the crime of theft in the office and period of time in question. For this reason, we explain the importance and necessity of having an updated and sufficient fingerprint database.
