Factores que generan sobrecarga procesal que vulneran el derecho a la tutela jurisdiccional efectiva en el juzgado mixto de la provincia de La Convención en el año 2018-2019

Abstract

La presente investigación tuvo por objetivo general, determinar de qué manera se vulnera el Derecho a la Tutela Jurisdiccional Efectiva en el Juzgado Mixto de la Provincia de la Convención en el año 2018-2019 con los factores que generan sobrecarga procesal. Los objetivos específicos están referidos a determinar cómo inciden los factores que generan la sobrecarga procesal que presenta el Juzgado de la provincia de La Convención en el año 2018-2019, sobre el derecho a la tutela jurisdiccional efectiva, determinar de qué manera incide la organización institucional que tiene el Juzgado Mixto del Poder Judicial en el año 2018- 2019, sobre el derecho a la tutela jurisdiccional efectiva y analizar cómo se produce la afectación al derecho de defensa por la generación de sobrecarga procesal. Se postuló como hipótesis general que: “Se vulnera el derecho a la Tutela Jurisdiccional Efectiva cuando por factores generadores de sobrecarga procesal no se respetan las garantías mínimas del proceso en el juzgado mixto de la provincia de La Convención en el año 2018- 2019”. Dentro del marco teórico se desarrolló y analizó teoría pertinente de Derecho Constitucional y derecho procesal general, que fundamenta el trabajo de investigación. He objective of this investigation was to determine how the Right to effective jurisdictional protection is violated in the Mixed Court of the Province of La Convention in the year 2018-2019 with the factors that generate procedural overload. Within the theoretical framework, the relevant theory of Constitutional Law and general procedural law, which underlies the research work, was developed and analyzed. The fundamental recommendation refers to the fact that the Superior Court of Justice of Cusco, Quillabamba headquarters, must conduct field studies in order to determine the situational status of each of its jurisdictional bodies, especially that of the Mixed Court of the Convention, also generate administrative rules that induce the permanent procedural discharge and the collection of truthful and current statistical information and create a pool of jurisdictional auxiliaries that should rotate from court to court.
