Factores ambientales y jurídicos que hacen necesario la implementación del instrumento técnico normativo del plan urbano distrital en la Municipalidad Distrital de Saylla contemplado en la Ley Orgánica de Municipalidades

Abstract

El presente trabajo de investigación está enfocado en conocer los factores ambientales y jurídicos que hacen necesario la implementación del plan urbano distrital en la Municipalidad Distrital de Saylla, siendo ella una de las funciones específicas de las municipalidades distritales que se encuentra contemplado en la Ley Orgánica de Municipalidades Ley N° 27972.

El distrito de Saylla presenta un crecimiento urbanístico acelerado y no planificado en las laderas de los cerros, evidenciándose construcciones de viviendas, remoción de tierras, así como la apertura de trochas carrozables, situación que amerita desarrollar un plan de acción a fin de que se evite las construcciones informales y la depredación que viene sufriendo las laderas de los cerros que forman parte de nuestro medio paisajístico característico del valle sur.

Es así que se plantea como objetivo principal determinar cuáles son los factores ambientales y jurídicos que hacen necesario la implementación del instrumento técnico normativo del plan urbano distrital en la Municipalidad Distrital de Saylla contemplado en la Ley Orgánica de municipalidades, utilizando para este trabajo un enfoque cualitativo, el tipo de investigación será aplicada, el tipo de investigación jurídica es socio jurídica y el nivel es descriptivo explicativo.

This research work is focused on knowing the environmental and legal factors that make it necessary to implement the district urban plan in the Saylla District Municipality, being one of the specific functions of the district municipalities that is contemplated in the Organic Law of Municipalities Law No. 27972.

The Saylla district presents an accelerated and unplanned urban growth on the slopes of the hills, showing housing construction, land removal, as well as the opening of carriage trails, a situation that warrants developing an action plan in order to avoid the informal constructions and the depredation that the slopes of the hills that are part of our characteristic landscape of the southern valley have been suffering.

Thus, the main objective is to determine which are the environmental and legal factors that make it necessary to implement the technical normative instrument of the district urban plan in the Saylla District Municipality contemplated in the Organic Law of municipalities, using a qualitative approach for this work. , the type of research will be applied, the type of legal research is socio-legal and the level is descriptive and explanatory.
