Tenencia exclusiva y el interés superior del niño en los procesos de tenencia en el juzgado de familia de la ciudad del Cusco en el año 2020

Abstract

En el presente trabajo de investigación para optar el grado de magister de la maestría en Derecho civil y comercial con el tema: “Tenencia exclusiva y el interés superior del niño en los procesos de tenencia en el Juzgado de Familia de la ciudad del Cusco en el año 2020”; realice un análisis profundo de forma sistemática evaluando todos los elementos que se encuentren relacionados con el objeto de la presente investigación. Asimismo, en el primer capítulo se puede verificar la realidad del problema estudiado, sobre la Tenencia Exclusiva, dicho problema podemos evidencias en los casos que se presentan de tenencia ante los Juzgados de Familia; procediendo a continuar realizando los estudios de planteamientos teóricos, las normas y legislación comparada con respecto a la variable a estudiar, lo cual nos lleva a la formulación del problema donde plantearemos la hipótesis con sus variables y objetivos de la misma; en el segundo capítulo, se consignó los métodos, el tipo y el diseño de la investigación, posterior de su variable y operacionalización, se desarrolló una guía de entrevista a profesionales que dieron su opinión de acuerdo a como diferencian la tenencia compartida y exclusiva , que se tomó en cuenta durante la presente investigación; en el tercer capítulo, se desarrollo los resultados y la discusión de los mismos. Finalmente se desarrollaron las conclusiones y recomendaciones, donde se arribó a la conclusión que los jueces deben tomar en cuenta diversos criterios para poder determinar la tenencia de un menor, debiendo valorar evaluaciones, la opinión del menor, las posibilidades económicas del progenitor que obtendrá la tenencia lo cual debe considerar que este aporte en la educación del menor; asimismo de procurar su alimentación, vestimenta, salud, conducirlos al colegio, a pasear, a conocer nuevos lugares y compartir con sus abuelos así como con los parientes más cercanos; siendo todo aquello que tiene que darse para la atención y cuidado directo de los hijos que estén bajo su tutela; siendo que de esta forma fortalece los vínculos familiares y el desarrollo integral del menor.

Likewise, in the first chapter, the reality of the problem studied can be verified, on Exclusive Tenure, we can evidence this problem in the cases that are presented of possession before the Family Courts; proceeding to continue carrying out the studies of theoretical approaches, the norms and comparative legislation with respect to the variable to be studied, which leads us to the formulation of the problem where we will propose the hypothesis with its variables and objectives of the same; In the second chapter, the methods, type and design of the research were recorded, after its variable and operationalization, an interview guide was developed for professionals who gave their opinion according to how they differentiate shared and exclusive tenure, which was taken into account during the present investigation; In the third chapter, the results and their discussion are developed. Finally, the conclusions and recommendations were developed, where it was concluded that the judges must take into account various criteria to be able to determine the possession of a minor, having to assess evaluations, the opinion of the minor, the economic possibilities of the parent who will obtain the possession. which must consider that this contribution in the education of the minor; also to ensure their food, clothing, health, drive them to school, to walk, to see new places and share with their grandparents as well as with the closest relatives; being everything that has to be given for the attention and direct care of the children who are under their guardianship; being that in this way it strengthens family ties and the integral development of the child.
