During the research I seek to find the parallels that are appropriate for surrogacy and Peruvian legislation, especially on the General Health Law No. 26842 in its article 7; Yes, it is prudent and necessary to establish safeguard mechanisms regarding the latter in the use of reproduction alternatives as established in said standard. In the research, I propose that Peruvian legislation establishes regulations that help to internalize the international standards that established guidelines for surrogacy. In some countries, the protection of the family is more rigorously enlisted, but in our legislation, two ways of protecting both are established. For the subject who requests an alternative to reproduce, it indirectly leads to the surrogacy contract, forgetting that it is not regulated, and that the general health law does not recognize it. The same path is introduced to the different norms and rights that each subject has for the protection of their right to reproduce or the right to personality, if these rights converge or affect a third party that involves their well-being or their life. Now, surrogacy has its mechanisms, although it is true, in our neighborhood, there are countries like Brazil and Colombia, that the mechanisms to safeguard and protect in favor of those who contract surrogacy, are different mechanisms that evaluate for the protection. As part of the conclusion, I seek that there be a new section that allows assisted reproduction established in article 7 of the General Health Law No. 26842, to have the possibility of evaluating, if necessary, containing within said norm, the possibility of surrogacy with certain requirements established for the citizen or subject who requests and allows the right of no person to be affected.
