In this research, the general objective is to “Identify the impact on the fundamental right to health by overcrowding in the Qquenccoro prison - Period 2020“. We have investigated whether the right to health is affected by overcrowding, even more so in the context of the COVID-19 pandemic, in which urgent measures are needed to guarantee the different rights, as well as to ensure the dignified conditions that each human being needs. Among the conclusions we reached were: First: In the Qquenccoro penitentiary, the capacity to house approximately 1,616 inmates, however, to date it houses approximately 2,988 male inmates, with an overcrowding and overcrowding of 1,372 inmates (it is located in 184% occupancy) existing overcrowding and overcrowding. Civil servants can do little or nothing in the face of this difficult reality, violating the fundamental rights of inmates, such as the right to health, education, and others. Second: Overcrowding in prisons at the Latin American and national level affects the function of prisons, causing the violation of different fundamental rights. The application of prison policies in the Qquenccoro Penitentiary Center in these overcrowded conditions is practically difficult, it reduces the care capacity of both the facilities and the intramural services: health, security and attention in other services. Third: The criminal overcrowding in the Qquenccoro Penitentiary Center affects the fundamental right to health, since it causes precarious health and hygiene conditions, which is aggravated in the current context due to the greater risk due to the advance of COVID-19; since it is not possible to comply with biosafety protocols, there are different age groups among inmates in vulnerable situations, such as elderly, diabetic, hypertensive, immunosuppressed patients, cancer patients, with autoimmune diseases, with heart failure and chronic kidney failure , among others. Therefore, the fundamental right to health is affected by overcrowding in the Qquenccoro prison in the 2020 period. Fourth: The increase in the population density of the Qquenccoro Penal Establishment has exceeded the shelter capacity, being inmates with preventive detention a total of more than 42% of the prison population, evidencing that it is one of the main causes of prison overcrowding that causes the problem of insufficient infrastructure.
