Abstract: El presente trabajo de investigación jurídica, tiene por finalidad saber más alcances
si la incoación del proceso inmediato, vulnera al derecho de defensa siendo este un
proceso especial que se encuentra reglamentado en la sección primera del libro V del
Código Procesal Penal de 2004 (CPP.), a razón de que el 30 de agosto de 2015 fue
publicado en el diario oficial el Peruano el Decreto Legislativo N° 1194, el cual entro en
vigencia el 29 de noviembre del 2015 norma que faculta legislar en materia de seguridad
ciudadana, fortalecimiento de la lucha contra la delincuencia y el crimen organizado,
delegando el Congreso de la Republica al Poder Ejecutivo mediante Ley 30336 el 1 de
julio de 2015, bajo el Decreto Legislativo aludido regula el proceso inmediato en caso de
flagrancia delictiva, modificando los artículos 446, 447 y 448 del Código Procesal Penal
vigente.
El citado Decreto Legislativo 1194 vigente, estableció nuevas reglas para su
tramitación, ante ello se presentaron diversos cuestionamientos por parte de la dogmática
nacional respecto a los supuestos de aplicación del proceso inmediato, y como una forma
de contribuir a aclarar las dudas generadas en torno al Proceso inmediato y su afectación
al Derechos de Defensa, ya que establece plazos perentorios y procedimientos
simplificados. Y en razón a la modificatoria sufrida de nuestro Nuevo Código Procesal
Penal del 2004, (NCPP).
En el presente trabajo de investigación, se analizó cuáles son las causas que
afectan o limitan el ejercicio del derecho de defensa sobre el plazo razonable en la
incoación en el proceso inmediato por parte de la fiscalía, ya que el derecho de defensa es una garantía constitucional que comprende la facultad de intervenir en el
procedimiento penal abierto para decidir acerca de una posible reacción penal, no se
puede dejar en un estado de indefensión al imputado al no contar con elementos de prueba,
como es el caso que se ocupa en la vulneración al derecho de defensa en la incoación del
proceso inmediato.
The present work of legal investigation, aims to know more scope if the opening of the immediate process, violates the right of defence, which is a special procedure that is regulated in the first section of Book V of the Code of Criminal Procedure of 2004 (CPP.), since on August 30, 2015, Legislative Decree N°1194 was published in the official newspaper El Peruano, which entered into force on November 29, 2015, legislation that enables legislation on citizen security, strengthening the fight against crime and organized crime, delegating the Congress of the Republic to the Executive Power by Law 30336 on July 1, 2015, under the aforementioned Legislative Decree regulates the immediate process in case of criminal flagrancy, modifying articles 446, 447 and 448 of the Code of Criminal Procedure in force. The aforementioned Legislative Decree 1194 in force, established new rules for its processing, before which various questions were raised by the national dogmatic regarding the cases of application of the immediate process, and as a way of helping to clarify the doubts generated about the Immediate Process and its impact on the Rights of Defence, since it establishes peremptory deadlines and simplified procedures. And because of the modification suffered by our New Code of Criminal Procedure of 2004, (NCPP). In the present work of investigation, it was analyzed which are the cases that affect or limit the exercise of the right of defense on the reasonable time in the opening of the immediate process by the prosecutor’s office, since the right of defence is a constitutional guarantee which includes the power to intervene in open criminal proceedings to decide on a possible criminal reaction, the accused cannot be left defenseless in the absence of evidence, as in the case of the infringement of the right of defence in the immediate proceedings.
