The present research has the objective, realize, report and promote the children´s rights of our country who they´re being recruitment victims by subversive groups, specifically “Sendero Luminoso” (SL), led by el comrade “Jose”, Victor Quispe Palomino, who committed 276 attacks between 1999 and 2017, for terrorist purposes, facts that constitute a situation that deserve a study space to specify which are the Fundamental Rights that are being violated, because it constituted a crime grievance to humanity which have been actions of organized civil community and the state against these events. The research methodology is it is dogmatic and hermeneutic, with qualitative and descriptive approach, likewise the design that was used is based grounded and non-experimental theory. The results of this research work, could contribute valuable information, that help in the implementation and application of new strategies by “Fuerzas del Orden” (FFOO) like the state. So that prevent it from continuing the forced recruitment to child by subversive groups in the “Valles del Río Apurímac, Ene y Mantaro” (VRAEM). The study was tackled from a qualitative documentary approach agree with the kind of socio-legal research because we approach a social problem from the legal perspective.
