The right to vote constitutes the foundation of democracy on which the will of the people lies, the freedom to choose. None of the electoral authorities can infringe it since people have the protagonism in the democratic elections, not the electoral ruling or rules interpreted on their own. The unusual role assumed by the National Jury of Elections and the National Organization of Electoral Processes during the general elections of 2016, based on the modification of Article 42 of the Law of Political Parties, infringes upon the democratic the system by generating differences on the application of the law and the lack of political consensus. Not only charging politically the reasoning that must have been legal in the judgement issued, but also disrupting the nature of the electoral process, up to the point of generating incertitude and confusion in the voters who would see how their decision was being manipulated, their right to vote. The climate of instability created by the electoral authorities resulted in elections filtered in a political tint putting aside some sectors of the population that had already voted because certain aspects, not in accordance with the law were legally justified and/or argued in a subjective way and with a clearN deference to certain candidates. It is in this way that the above-mentioned law urges to be modified and even so reforms of constitutional-electoral nature need to be made in order to make the activities of political parties transparent and in pursuit of seeing the population as a major player of this democratic celebration that is the elections.
