The principle of equality between the parties is a principle-right that is enshrined in the Constitution that states that “No one should be discriminated against on the basis of origin, race, sex, language, religion, opinion, economic condition or of any other nature.“ Under the protection of Law No. 30364 “LAW TO PREVENT, PENALTY AND ERADICATE VIOLENCE AGAINST WOMEN AND MEMBERS OF THE FAMILY GROUP,“ this principle is violated at the time of the testimonial statement, giving women greater credibility regarding the Valuation of your statement that with this alone can unnerve the presumption of innocence of the accused. For them, the test is used, which is a fundamental tool to determine the innocence or guilt of a punishable act that must follow certain procedures and formalities. The testimonial statement is your type of evidence offered by the victim, but for its origin certain parameters must be followed because said statement may be protected by vices or even personal reasons, which is why correct application of the law is important in cases of violence against women. Violence against women is a social evil that has been dragged down over the years in its different forms, whether in the public or private sphere. What the law seeks is to empower women by providing protection mechanisms, but at their Once these mechanisms may violate rights.
