The law 29785 or “Law of the right to prior consultation of indigenous peoples,recognized in Convention 169 of the International Labor Organization (ILO)“, has thepurpose of developing a procedure of consultation driven by stages in order to reach an agreement between the State and indigenous peoples when the legislative oradministrative means directly affect them both their collective rights, their physicalproperty, cultural identity, quality of life or development. However, there are problemsin its execution, such as conflict of interest, since the consultation is carried out by thesector that promotes the measure, for example, in the case of hydrocarbon exploitation processes. Therefore, an impartial entity should be assigned to act as an intermediarybetween the promoter sectors and indigenous organizations. Likewise, a follow-upprotocol is required for agreements reached as a result of prior consultation. In this way it is necessary to deepen the capacity for dialogue with the populations of indigenouscultures, granting the respective training. In this sense, this thesis found legal andfactual differences that justify granting the Binding Character to the Results of the PriorConsultation to Indigenous or Native Peoples, as established by Law N ° 29785, which were analyzed during the development of the present investigation.
