Falta de acceso al agua en la A.P.V Qhapañan del distrito de Cusco como violación al derecho fundamental al agua consagrado en el art. 7-a de la Constitución Política del Perú

Abstract

El derecho al agua, incorporado en la Constitución Política del Perú en el Art. 7-A, tan solo constituye una expresión literal de dicho derecho, ya que su reconocimiento se dio en distintos instrumentos internacionales años atrás, por lo tanto, el derecho investigado presenta un mayor avance doctrinal y jurisprudencial en el ámbito internacional, sin embargo a pesar de su reconociendo a nivel de los instrumentos internacionales el marco jurídico peruano no maneja un buen avance en cuanto a la protección del derecho en mención. Es, por lo tanto, que el presente trabajo de investigación tiene como finalidad aportar conocimientos teóricos en cuanto al derecho al agua y las obligaciones que demandan para los distintos Países a nivel mundial y de aplicación obligatoria para el estado peruano. El presente trabajo, toma como lugar de investigación la A.P.V Qhapañan del Distrito del Cusco, en cual se verificará el acceso pertinente de agua, cuyo contenido debe ser protegido y tutelado por los operadores estatales, además se desarrollara temas en cuanto al contenido y alcances de la incorporación del derecho fundamental al agua, que debe reflejar lo establecido por los organismos internacionales, que exigen que una serie de obligaciones y derechos de los miembros de una sociedad determinada.

The right to water, incorporated in the Political Constitution of Peru in Art. 7-A, only constitutes a literal expression of said right, since its recognition was given in different international instruments years ago, therefore, the investigated right It presents a greater doctrinal and jurisprudential advance in the international sphere, however, despite its recognition at the level of international instruments, the Peruvian legal framework does not handle a good advance in terms of the protection of the right in question. It is, therefore, that this research work aims to provide theoretical knowledge regarding the right to water and the obligations demanded for different countries worldwide and mandatory for the Peruvian state. The present work, takes as a place of investigation the APV Qhapañan, in which the relevant access of water will be verified, whose content must be protected and protected by the state operators, in addition topics will be developed regarding the content and scope of the incorporation of the right fundamental to water, which must reflect what is established by international organizations, which require a series of obligations and rights of the members of a given society.
