The general objective of this research was to analyze the main negative implications of Law No. 31590 (Shared Tenancy Law in Peru), it was postulated as a general hypothesis that the main negative implications of Law No. 31590 (Shared Tenancy Law in Peru) in the protection of the rights of children and adolescents after a family separation are related to the analysis that must be carried out in each specific case, as well as the measures to be adopted to guarantee an equitable distribution of time and responsibility. between the parents, in consideration of the Best Interest of the Child and Adolescent and their right to psychological integrity and comprehensive well-being. The research was qualitative of a Dogmatic-Analytical Legal type, for which the data collection techniques were used: analysis of specialized texts, scientific articles, investigations, sentences issued by the Family Court and interviews with legal operators, the hypotheses were validated and the main conclusion corroborates the general hypothesis in the following sense that the negative implications are the violation of the right to the integrity of the minor and the Best Interest of the Child as a consequence of the application of Law No. 31590 (Shared Tenancy Law ) without carrying out an analysis of each specific case for its application, with the understanding that each family reality is different in the economic, psychological and social spheres. The fundamental recommendation is aimed at the Specialized Family Judges, when applying shared possession, analyze each specific case and not apply it as a general rule in order to safeguard the rights of children and adolescents.
