Abstract: La presente tesis titulada “La eficacia de las medidas de protección en procesos de
violencia familiar contra las mujeres en el distrito de Cusco”, se desarrolla debido a la
necesidad de establecer la eficacia de las medidas de protección, por tanto, es importante
precisar el nivel de incidencia de los factores que acarrean a la transgresión de una medida de
protección, lo que imposibilita la tutela adecuada a la mujer que es víctima de violencia
familiar. Debido a ello el problema general de este estudio es ¿Por qué no fueron eficaces las
medidas de protección que se dictaron en los procesos sobre violencia familiar contra las
mujeres del distrito del Cusco?
Respecto a la metodología la investigación tiene diseño descriptivo exploratorio, y para
la recolección de datos se utilizó la técnica de la entrevista a tres jueces del Juzgado de Familia
del Cusco y se realizó el análisis documental de 18 expedientes en los que se transgredieron
las medidas de protección dictadas por el Juzgado de Familia del Cusco en el año 2019. Con
todo lo anterior se llega a determinar que las medidas de protección dictadas no se encuentran
acordes a la necesidad y a la realidad de las víctimas, menos aún se le da trascendencia a los
factores de más incidencia como lo son el alcoholismo (factor individual) y los estereotipos de
género (factor cultural) por las que se otorga medidas de protección.
Por último, la investigación demuestra que no se protege de una nueva agresión a la
víctima aun cuando existen medidas de protección dictadas por los Juzgados de familia del
Cusco; únicamente se infringe el carácter tuitivo de la ley Nº 30364, resultando en la ineficacia
de las medidas de protección.
