This research is framed into the guidelines established by labor law in Perú, through this investigation we want to disclose themes related to factors that affected the hiring process of serenazgo workers in the labor regime of legislative decree No. 1057 between the years 2015 to 2018 in the Provincial Municipality of Cusco. Thus, it was possible to verify there were two factors that had special relevance for serenazgo workers to be hired within the legislative decree No. 1057, these factors were legal and legal. On one hand, we will see legal factors which were based on the inapplicability of the norms, ignorance of labor rights, as well as the lack of regulation of laws; and on the other hand, political factors, which were originated by political affinity, inadequate policies and the unequal budget distribution, that were taken advantaged by the Provincial Municipality of Cusco, that’s why recruitment of serenazgo workers took a different course that law enabled. As a result, the legal factor was the most influential in the hiring of said personnel. In conclusion, it was confirmed during the period 2015 - 2018 that the Provincial Municipality of Cusco hired serenazgo workers under a regime that violates their rights as workers, it means Municipality of Cusco use “CAS” contracts (governed by Legislative Decree No. 1057) to avoid paying benefits to workers who belong to the private activity regime, therefore, it was evident that their rights as workers were infringed.
