La defensa jurídica de la procuraduría pública en la preservación de los intereses del Gobierno Regional-Cusco, enero- setiembre del 2023

Abstract

La presente investigación titulada “LA DEFENSA JURÍDICA DE LA PROCURADURÍA PÚBLICA EN LA PRESERVACIÓN DE LOS INTERESES DEL GOBIERNO REGIONAL- CUSCO, ENERO – SETIEMBRE DEL 2023” tuvo como principal objetivo el de analizar las dificultades que enfrenta la Procuraduría Pública en la tramitación de los procesos al defender los intereses del Gobierno Regional- Cusco, enero- setiembre 2023. Teniendo como metodología de investigación un tipo de investigación básico aplicado, con un enfoque cualitativo y con el diseño de teoría fundamentada; se tuvo como principales resultados, la obtención de las entrevistas aplicadas al personal de la Procuraduría Pública Regional así como también el análisis correspondiente sobre la carga procesal que se tiene como elemento integrante en las consecuencias negativas de las dificultades teniendo como resultados la obtención de más procesos perdidos que ganados en las diferentes áreas, dificultades financieras que afecta incluso la exclusión o continuación de personal que labora en la Procuraduría Pública Regional y así tener un aumento en la carga mas no, en el recurso humano necesario para poder afrontar los procesos judiciales de una manera adecuada; en este entender se tiene como conclusión principal que: Se logró demostrar que la falta de recursos humanos y mala tramitación de documentación en la Procuraduría Pública Regional debilita significativamente la capacidad del Gobierno Regional para defender sus intereses en disputas legales. La escasez de personal capacitado y la carencia de respuestas oportunas a información solicitada a otras entidades contribuyen a una representación deficiente en los tribunales, aumentando el riesgo de pérdida de casos cruciales.

The present investigation entitled "THE LEGAL DEFENSE OF THE PUBLIC PROSECUTOR'S OFFICE IN THE PRESERVATION OF THE INTERESTS OF THE REGIONAL GOVERNMENT - CUSCO, JANUARY - SEPTEMBER 2023" had as its main objective to Analyze the difficulties faced by the Public Prosecutor's Office in the processing of processes when defending the interests of the Regional Government - Cusco, January-September 2023. Having as a research methodology a type of basic applied research, with a qualitative approach and with the design of grounded theory; The main results were the obtaining of interviews applied to the staff of the regional public attorney's office, as well as the corresponding analysis of the procedural burden that is an integral element in the negative consequences of the difficulties in the financial results that it affects. even the exclusion or continuation of personnel who work in the attorney general's office and thus have an increase in the burden but not in the human resources necessary to be able to face judicial processes in an adequate manner; In this understanding, the main conclusion is that: It was demonstrated that the lack of human resources and equipment in the Regional Attorney's Office significantly weakens the capacity of the regional government to defend its interests in legal disputes. Shortages of trained staff and lack of appropriate tools contribute to poor representation in court, increasing the risk of losing crucial cases.
