Incumplimiento del artículo 51° del reglamento interno del Cuerpo General de Bomberos Voluntarios del Perú y el derecho a la salud mental de los miembros de la Compañía Cusco B-39

Abstract

La presente tesis versa sobre el derecho fundamental a la salud, en su dimensión de salud mental, tuvo su génesis identificando una problemática que se vive a nivel nacional, puesto que con el transcurrir del tiempo nadie se ha preocupado por velar por el derecho a la salud mental de los Bomberos Voluntarios del Perú, ni por el respeto de su dignidad. Esta investigación pretende determinar de qué manera el incumplimiento del artículo 51° del Decreto Legislativo N° 1260, Decreto que rige y fortalece el Cuerpo General de Bomberos Voluntarios del Perú, afecta el derecho a la salud mental en los miembros de la Compañía de Bomberos Voluntarios Cusco B-39. Siendo así, que este artículo establece el bienestar y la protección de los integrantes de dicha organización, así como, velar por ellos a través de programas y servicios especiales de salud física y salud mental, evitando su desprotección. Asimismo, la Dirección de Bienestar está encargada de la implementación y funcionamiento de una Oficina de Psicología, sin embargo, lo señalado en esta normativa no se cumple ni se respeta. No olvidemos que la labor del bombero voluntario es ardua, puesto que implica la entrega de esfuerzo, sacrificio, muchas veces, de manera desinteresada y por el amor a su prójimo arriesgan sus propias vidas. Se establecerá la relevancia del acceso a los servicios de salud mental por parte de estos efectivos, pues ellos están expuestos a situaciones límites durante su respuesta a emergencias, por lo que es necesario atender y merecer especial protección, por ser un derecho inseparable de la vida de la persona.

This thesis is about the fundamental right to health, in its mental health dimension, had its genesis identifying a problem that is experienced at the national level, since over time no one has bothered to ensure the right to mental health of the Voluntary Firefighters of Peru, nor for the respect of their dignity. This investigation aims to determine how the breach of article 51 of Legislative Decree No. 1260, Decree that governs and strengthens the General Fire Department of Peru, affects the right to mental health in the members of the Cusco Volunteer Fire Company B-39. Thus, this article establishes the well-being and protection of the members of said organization, as well as, looking after them through special physical and mental health programs and services, avoiding their lack of protection. Likewise, the Welfare Directorate is in charge of the implementation and operation of a Psychology Office, however, what is stated in this regulation is not complied with or respected.

Let us not forget that the work of the volunteer firefighter is arduous, since it implies the dedication of effort, sacrifice, many times, in a disinterested way and for the love of their neighbor they risk their own lives. The relevance of access to mental health services by these troops will be established, since they are exposed to extreme situations during their response to emergencies, so it is necessary to attend and deserve special protection, as it is an inseparable right of life. of the person.
