This thesis is about the fundamental right to health, in its mental health dimension, had its genesis identifying a problem that is experienced at the national level, since over time no one has bothered to ensure the right to mental health of the Voluntary Firefighters of Peru, nor for the respect of their dignity. This investigation aims to determine how the breach of article 51 of Legislative Decree No. 1260, Decree that governs and strengthens the General Fire Department of Peru, affects the right to mental health in the members of the Cusco Volunteer Fire Company B-39. Thus, this article establishes the well-being and protection of the members of said organization, as well as, looking after them through special physical and mental health programs and services, avoiding their lack of protection. Likewise, the Welfare Directorate is in charge of the implementation and operation of a Psychology Office, however, what is stated in this regulation is not complied with or respected. Let us not forget that the work of the volunteer firefighter is arduous, since it implies the dedication of effort, sacrifice, many times, in a disinterested way and for the love of their neighbor they risk their own lives. The relevance of access to mental health services by these troops will be established, since they are exposed to extreme situations during their response to emergencies, so it is necessary to attend and deserve special protection, as it is an inseparable right of life. of the person.
