Aggression against women or members of the family group has increased alarmingly in our country and, consequently, the complaints filed with the PNP Family Commissioners and the Public Prosecutor's Office, which is why critical stages are currently being experienced in the administration of justice and with respect to the procedural load in State institutions (Public Ministry and Judicial Power), this being the case when the time comes to impart justice and initiate an investigation, there are difficulties in questioning the psychological legal system and in proving the psychological affectation, cognitive or behavioral in the victim, since any act of family violence violates the physical and psychological integrity of the family group. The Criminal Code specifically considers the types of psychological, cognitive or behavioral affectation, however in legal praxis, it is complex for the representative of the Public Ministry to impute a behavior determined by the damage to the emotional stability of the aggrieved party, due to that this affectation that it presents at the time of being evaluated could have been caused by other agents in different times and spaces, so it is questionable to establish whether the conduct displayed by the alleged perpetrator could generate the psychological alteration that the aggrieved party presumes, given the subjective level of law, the issue resides for justice operators in how to sustain an accusation and discuss psychological issues, since the criminal type is based on subjective issues, while in a fiscal investigation a criminal act that took place on a date is investigated. true, consequently it is difficult to be certain if the behavior displayed by the person investigated for the crime he is accused of, is related to the psychological affectation of the victim, since since it is a subjective matter, it is difficult to have a degree of certainty for the issuance of a conviction. It is understood that when classifying this behavior, the legislator did not take into account the emotional aspect of the person, but rather the cognitive and behavioral symptoms to frame the psychological affectation; which brings as a consequence difficulty of correlation between the norm and psychology at the time of attributing responsibility to the investigated, given the disproportionate increase in complaints of family violence specifically for physical and psychological aggression, it is not possible to be certain if these facts will be related to the psychological affectation, whether cognitive or behavioral, that the aggrieved party may present, regarding the facts attributed to the accused; these elements being necessary for the configuration of the criminal type, even more so if the psychological skills are not issued according to the guidelines parameters of the Guide to determine the psychological affectation, authorized by the Institute of Legal Medicine, which should serve as a manual for any other expert.
