For the sake of legal knowledge, the research thesis entitled “VULNERATION OF CONSTITUTIONAL RIGHTS BY THE EFFECT OF MINING ENVIRONMENTAL LIABILITIES IN THE PROVINCE OF ESPINAR OF THE CUSCO DEPARTMENT, 2016“ was carried out. This investigation, conducted formally and efficiently, responds to the need to determine whether the constitutional rights of the individual are being vulnerable due to the effect of Environmental Miners liabilities in the province of Espinar. Aspect that is of interest for the law and that is composed of the study of both the environmental norms, as well as of the constitutional norm, which is an analysis of this problematic that is presented in one of the poorest provinces of Cusco, that nevertheless It has the presence of large mining companies that develop their extractive activities in this sector and whose interrelationships generate social and legal problems, where the State – as a regulator - is forced to intervene to enforce the rights of the settlers, Como The rights of mining companies, with the aim of generating an environment of tranquility, balance and good coexistence respecting Peruvian regulations and observing the international treaties of which they are part and in the integral development of the Peruvian State.
