Currently in Peruvian Succession Law, the institution of Succession Representation, regulated in Article 681 of the Civil Code, empowers its exercise to descendants in unlimited straight line, and exceptionally to collateral relatives up to the second degree of kinship by consanguinity; Thus, the legislator and the rule have exempted the surviving spouse from the exercise of the Succession Representation, which generates a situation of inequality and lack of protection for the latter, since he/she is prevented from receiving the inheritance quota that in life would have corresponded to his/her pre-deceased spouse. In this sense, the main purpose of this research work is to determine the legal, social and economic reasons that justify the regulation and consequent exercise of the Succession Representation by the surviving spouse, through a legal research of a dogmatic-propositional type with a qualitative approach, which implies a broad doctrinal and jurisprudential analysis of the institutions involved in this research, together with the application of interviews and collection of information at a doctrinal level, as well as pragmatic jurisprudence and judicial. Thus, based on the results and conclusions obtained, it has been determined that there are two cases of a legal, social and economic nature, which motivate the surviving spouse to exercise the Succession Representation, in order to establish a proposal for a regulatory reform by which a second paragraph will be added to the referred article 681° of the Civil Code.
