The present work called: “LEGAL AND SOCIOECONOMIC BARRIERS THAT PREVENT ACCESS TO MENTAL HEALTH SERVICES AND HOW THE FUNDAMENTAL PRINCIPLE OF THE RIGHT TO HEALTH CONTEMPLATED IN ARTICLE 7 OF THE POLITICAL CONSTITUTION OF PERU IS AFFECTED” first originates as a questioning to the little importance given to Mental Health, even more so now: after a pandemic that has exacerbated many symptoms and consequently worsened mental illnesses and disorders. Thus, from university classrooms it is important to analyze this issue, especially from the legal side, since many rights are regulated; However, in reality these rights are only reflected in letters, but not in facts. This thesis analyzes and describes the legal, social and economic barriers that hinder access to different health services guaranteed by the State. These barriers have been subcategorized into the limitations and contradictions presented by the Mental Health Law, the Standard Technique of Community Mental Health Centers, the stigma towards people with mental disorders, the budget allocated to mental health, poverty, among others. Thus, interviews were used as a technique, which were answered by mental health specialists, by legal specialists and by patients who expressed that effectively in the province of Cusco the rights to mental health are not guaranteed.
