Abstract: El presente trabajo de investigación busca determinar si es factible incorporar el Recurso de
Reconsideración de la Tacha Sustantiva en el Procedimiento Registral Peruano, con la finalidad
de dar a conocer a la comunidad jurídica la importancia de incorporar el mencionado recurso
impugnativo en el Texto Único Ordenado del Reglamento General de los Registros Públicos.
En vista de que el Registrador al momento de formular alguna tacha al título presentado por
el usuario, puede incurrir en algún error de apreciación del título presentado, error de interpretación
de las normas legales aplicables al caso en concreto o la inobservancia de algún precedente de
observancia obligatoria, siendo que, la única manera de poder estimar la decisión negativa del
Registrador es a través del recurso de apelación, el cual lleva un plazo promedio de emisión de la
Resolución por parte del Tribunal Registral de 04 a 05 meses, demorando excesivamente el
procedimiento registral, por lo que de existir el recurso de reconsideración podría reconsiderarse
la decisión del Registrador en un plazo menor.
En tal sentido, lo que se pretende con éste estudio es determinar la factibilidad de
incorporación del Recurso de Reconsideración de la Tacha Sustantiva en el Texto Único Ordenado
del Reglamento General de los Registros Públicos, con la finalidad de no dilatar innecesariamente
los plazos en el procedimiento registral peruano, además de hacerlo más viable a efectos de la
calificación registral formulado por el Registrador Público; así mismo, para otorgarle mayor
seguridad jurídica al usuario.
This research work seeks to determine whether it is feasible to incorporate the appellate procedure of the substantival strikeout in the Peruvian Registry Procedure, in order to make know to the legal community the importance of incorporating the aforementioned appeal in the TUO of the General Regulation of Public Registries. In view of the fact that the employee in charge of the registry at the moment of formulating a strikeout to the legal act requested to register submitted by the user, may incur in some error of appreciation of the legal act, error of interpretation of the legal norms applicable to the specific case or the non-observance of any mandatory observance precedent, the only way to estimate the negative decision of the employee in charge of registry is through the appeal, which takes an average period of issuance of the Resolution by the Registry Court from 04 to 05 months, delaying the registration procedure excessively. Therefore, if the reconsideration resource exists, the Registrar´s decision could be reconsidered in a shorter period. In this sense, what is intended with this study is to determine the feasibility of incorporating the Resource for Reconsideration of the Sustantive Tack in the TUO of the General Regulation of Public Registries, in order not to unnecessarily delay the deadlines in the procedure peruvian registry, in addition to making it more viable for the purposes of the registry qualification formulated by the public registrar; likewise, to grant greater legal security to the user.
