Abstract: El incremento de casos de esterilidad e infertilidad en el Perú ha generado que las
parejas y personas casadas busquen nuevas técnicas de reproducción asistida, con la
finalidad de que puedan concebir a un ser humano y forjar un legado. Dentro de estas
técnicas de reproducción asistida, encontramos a la maternidad subrogada o maternidad
por sustitución. Esta técnica de reproducción asistida ha venido siendo utilizada sin
regulación alguna, generando incertidumbre a las personas que lo practican, puesto que
dentro de la Ley General de Salud y el Código Civil, no se establece la prohibición o la
permisibilidad de esta técnica.
El presente trabajo de investigación tiene como objetivo conocer los argumentos
jurídicos-sociales que permitan la regulación de la maternidad subrogada en el Código
Civil Peruano, así también proponer los lineamientos normativos en los que se deberían
regular. La implicancia de los derechos de los padres imposibilitados a procrear, tales
como el libre desarrollo de la personalidad, la voluntad procreacional, derecho
reproductivo, protección familiar y al de construir una familia, fundamenta y hace
necesario que exista una regulación inmediata de la maternidad subrogada. Todo ello,
corroborado con los argumentos sociales, tales como la autorrealización familiar, el
incremento de infertilidad y esterilidad en las parejas, como la incertidumbre de la entrega
del recién nacido por parte de la mujer gestante a los padres de intención.
The increase in cases of sterility and infertility in Peru has led couples and married people to seek new assisted reproductive techniques, in order that they can conceive a human being and forge a legacy. Within these assisted reproduction techniques, we find surrogacy or surrogacy. This assisted reproduction technique has been used without any regulation, generating uncertainty for the people who practice it, since within the General Health Law and the Civil Code, the prohibition or permissibility of this technique is not established. The objective of this research work is to know the legal-social arguments that allow the regulation of surrogacy in the Peruvian Civil Code, as well as to propose the normative guidelines in which they should be regulated. The implication of the rights of parents unable to procreate, such as the free development of the personality, the procreation will, the reproductive right, family protection and that of building a family, grounds and makes it necessary for an immediate regulation of surrogacy. All this, corroborated with social arguments, such as family self-realization, the increase in infertility and sterility in couples, as well as the uncertainty of the delivery of the newborn by the pregnant woman to the intended parents.
