The investigation focuses on the legal effects faced by the Provincial Municipality of Cusco for not hiring municipal workers under the labor regime of private activity, violating the Organic Law of Municipalities and violating their labor rights. This situation has led the workers to resort to legal actions against the Municipality, arguing the violation of their labor rights by being hired under a different temporary regime or modality, despite performing inherent and permanent functions in the entity. The general objective is to analyze the legal effects of this practice during the period 2020-2021, while the specific objectives seek to improve hiring management to protect the labor rights of workers and explain the economic implications of not hiring them under the appropriate regime. The methodology used is deductive, with a legal-descriptive approach and descriptive level, employing a qualitative approach to explain the legal effects in the Provincial Municipality of Cusco. Documentary analysis and semi-structured interviews were used. The hypothesis was validated, demonstrating that failure to hire under the proper regime has generated significant legal effects, such as denaturalization of hiring, legal and financial implications, and the obligation to recognize and pay social benefits and compensation for violation of labor rights. It is recommended that the Municipality of Cusco hire more legal professionals in its Human Resources Office to guarantee the legal compliance of labor contracts and provide continuous legal advice, thus ensuring adequate hiring of municipal workers.
