Abstract: En fecha 18 de enero del 2017 se publicó en el Diario Oficial ‘‘El Peruano’’, la
Sentencia del IX Pleno Casatorio, en el Expediente N° 4442-2015, Moquegua,
sobre Otorgamiento de Escritura Pública, tramitado en la Vía Sumarísima, cuya
particular importancia era definir si en un proceso de naturaleza sumarísima podía
discutirse y resolverse la nulidad de un negocio jurídico cuya escrituración se
pretendía. Consideramos que en dicha sentencia se cometió un error, al señalar en
la sexta regla que, además, constituye precedente vinculante, que el juez está en la
posibilidad de declarar de oficio la ineficacia funcional de un negocio jurídico,
desde nuestro punto de vista ello es inconcebible por las mismas definiciones que
no encajan dentro de la declaración de oficio de un negocio jurídico tanto en nuestra
legislación como en el derecho comparado, en tal sentido, por medio de ésta
investigación de carácter cualitativo se desarrollará un esquema conceptual
suficiente y útil para determinar la imposibilidad del juez de declarar de oficio la
ineficacia funcional de un negocio jurídico. Estableciendo si es deber del Juez el
controlar la validez de un negocio jurídico regulado en el artículo 220º del Código
Civil y si dicho deber es aplicable a los supuestos de ineficacia funcional. En tal
sentido nuestra pregunta general recae en determinar si el juez está en condiciones
de realizar una declaratoria de oficio respecto a la ineficacia funcional en un
negocio jurídico la cual tiene estricta relación con el objetivo general de la
investigación y finalmente llegamos a una conclusión que da soporte a la hipótesis
planteada la cual señala que el juez no puede realizar un control sobre la ineficacia
funcional de un negocio jurídico por que la norma no lo faculta para ello y además
porque podría afectar intereses particulares o de terceros.
In January 18, 2017, the Sentence del IX Pleno Casatory, referring to File No. 44422015, Moquegua, on the Granting of Public Deed, processed in the Supreme Summons, whose particular Importance was to define if in a process of a very summary nature the nullity of a legal business whose deed was intended could be discussed and resolved. We consider that in this judgment an error was made when stating in the sixth rule that it also constitutes a binding precedent, that the judge is in a position to declare ex officio the functional ineffectiveness of a legal business, from our point of view this is inconceivable by the Same definitions that do not fit within the legal declaration of a legal business both in our legislation and in comparative law, in this sense, through this qualitative research, a sufficient and useful conceptual scheme will be developed to determine the impossibility of judge to declare ex officio the functional ineffectiveness of a legal business. Establishing if it is the duty of the Judge to control the validity of a legal business regulated in article 220 of the Civil Code and if said duty is applicable to the cases of functional ineffectiveness. In this sense, our general question lies in determining whether the judge is in a position to carry out an ex officio declaration regarding functional ineffectiveness in a legal business, which is strictly related to the general objective of the investigation, and finally we reach a conclusion that gives support to the hypothesis raised which indicates that the judge cannot carry out a control on the functional ineffectiveness of a legal business because the norm does not authorize it to do so and also because it could affect private interests or third parties.
