Implicancias del plazo de caducidad de acción en la causal de divorcio por Sevicia

Abstract

El presente trabajo de investigación tuvo por objetivo determinar si procede el plazo de caducidad de la acción en la causal de divorcio por violencia física o psicológica (sevicia); así también se buscó demostrar que existen fundamentos para modificar el plazo de caducidad en la causal de divorcio por violencia física o psicológica (artículo 339º del código civil); fundamentos que serán expuestos en la presente investigación.

El desarrollo del presente trabajo de investigación se ha visto por conveniente recurrir al estudio conceptos de: familia, que es la base fundamental para constituir una sociedad, matrimonio que es la unión de dos personas de diferente sexo que se encuentran en edad de contraer nupcias, divorcio que podemos indicar que es el fin de la relación conyugal, entre otros conceptos que ayudaron en la elaboración de la presente tesis. Así también se tuvo que recurrir al estudio de 11 expedientes judiciales de la Corte Superior de Justicia del Cusco en la que se advierte que el plazo de caducidad que signa el artículo 339º del código civil es únicamente de seis meses por lo que sería necesario la ampliación del plazo para tener un proceso más justo para salvaguardar los intereses de las partes.

Teniendo en cuenta que en el artículo 333º inciso 333º .2, sobre la causal de divorcio por violencia física o psicológica, que el juez apreciara según las circunstancias, es necesario indicar que la existencia de un conyugue culpable que somete a actos de crueldad o dureza a otro inocente o afectado, por último, la caducidad que es entendida como el plazo establecido para hacer valer un derecho reconocido por la norma, la que una vez cumplida, esta no podrá ser interpuesta. Finalmente se tiene en las conclusiones que se llegaron producto de la presente investigación, lo que llevo a plantear ciertas recomendaciones, que se plantea para un mejor análisis del tema tratado respecto al divorcio por violencia física o psicológica (sevicia).

The objective of this research work was to determine if the expiration term of the action in the cause of divorce due to physical or psychological violence (severeness) proceeds; Thus, it was also sought to demonstrate that there are grounds to modify the expiration term in the cause of divorce due to physical or psychological violence (article 339 of the civil code); fundamentals that will be exposed in the present investigation.

The development of this research work has been seen as convenient to resort to the study of concepts of family, which is the fundamental basis for constituting a society, marriage, which is the union of two people of different sex who are of marriageable age, divorce that we can indicate that it is the end of the marital relationship, among other concepts that helped in the elaboration of this thesis. Thus, it was also necessary to resort to the study of 11 judicial files of the Superior Court of Justice of Cusco in which it is noted that the expiration period that article 339º of the civil code signs is only six months, so it would be necessary the extension of the term to have a fairer process to safeguard the interests of the parties.

Taking into account that in article 333º subsection 333º .2, on the cause of divorce due to physical or psychological violence, which the judge will appreciate according to the circumstances, it is necessary to indicate that the existence of a guilty spouse who submits to acts of cruelty or harshness to another innocent or affected, finally, the expiration that is understood as the term established to assert a right recognized by the norm, which once fulfilled, this cannot be filed.

Finally, the conclusions reached as a result of this investigation are reached, which led to certain recommendations, which are proposed for a better analysis of the subject matter regarding divorce due to physical or psychological violence (severeness).
