The lawsuits for nullity of bankruptcy res judicata are intended to exclude certain creditors from a bankruptcy proceeding. These creditors support their claims in a judicial or arbitral decision or other act or agreement to which the law has granted a res judicata character obtained or created based on the simulation of credits. Given its importance, the purpose of this paper is to identify the reasons why some of the mentioned lawsuits are dismissed by the judiciary. The first chapter describes bankruptcy proceedings, as well as aspects related to the credit recognition procedure. Likewise, the second chapter addresses differences that exist between the nullity of fraudulent res judicata and the nullity of bankruptcy res judicata. The third chapter studies factors that determine that some of the lawsuits are dismissed by the judges, as well as a legislative amendment to improve its application by the judiciary. Finally, the last chapter explains the results obtained after consulting specialists in administrative law and bankruptcy law regarding the hypotheses formulated in this study about the effectiveness of the said legislative amendment. The conclusion reached is that a legal reform is necessary. It will contribute to the effective application of the said legal figure in order to exclude those who simulate credits into a bankruptcy proceeding.
