The present work was carried out in the city of Iquitos, with the objective of discovering the legal effects in credit contracts with interest rates not regulated by the Peruvian state and the controversies with the political constitution of Peru; The design was of the quantitative type, we surveyed 382 people randomly selected, to process the information we used the statistical package SPPS version 11; Obtaining results, that exists in the market of loans interest rates in usury conditions, reaching a 476% per annum in the financial, banking and non-banking system; Despite high interest rates, 48% of the loans granted have been to expand businesses, only 10% for medicines and personal consumption, none for education; With respect to whether the state would fix or regulate high interest rates for the benefit of consumers, the legal effect says that 33% would be helpful, while 32% would help businesses; With respect to disputes with legal certainty and the free market, the state would regulate or set the control of high interest rates: 31% think it is a great idea, however 23% believe that it will not eliminate usury; For efficient legal security the state must have control of interest rates. The 61% of more legal relevance, believes that the Peruvian state should have control of the interest rate, so the people ask that the interest rate be regulated by the Peruvian state. And only 24% say that the state should not have control of interest rates. Concluding that there are high interest rates in the credit market of Iquitos, both in the banking and non-banking system, there is an interest rate that reaches up to 476% per year. Proposing a single interest rate of 35% for the Annual Effective rate and 100% for the delinquency rate, the same ones that were extracted from the comparative table of the tariffs of the Banking and Non-Bank Companies, being Caja Maynas S.A. The lowest; The same that is also suggested to be 100% the highest maximum rate for the usury offense.
