The defense of constitutional rights is of vital importance in a rule of law. The present work was carried out in the environments of the Superior Court of Justice of Loreto, in the city of Iquitos, with the objective of knowing opinions regarding the violation of Article 398-B of the Criminal Code towards the constitutional right to work of the convicted in the judiciary of Iquitos; The type of study was quantitative and the design was exploratory and descriptive. The total population under study was 180 professionals made up of: Judges; Prosecutors and lawyers who work in the Judicial Branch of Loreto, Iquitos headquarters, the sample was made up of 41 people, the survey was used as a technique and an Likert Scale was used as an instrument, which obtained a validity of 80%. The results obtained were: 62% (26) of the subjects in the sample gave a favorable opinion regarding the contravention of Art. 398-B of the Criminal Code towards the right to work of the convicted, undecided 19.3% (8) and 18.3 (7) they said unfavorably, concluding that Article 398-B is unconstitutional. Therefore, the hypothesis set forth in this research paper is accepted that Art. 398-B of the Criminal Code of the Criminal Code contravenes the constitutional right to work of the convicted person.
