The purpose of this research is to analyze Law 30364 – Law to prevent, punish and eradicate violence against women and members of the family group, from a procedural perspective and to question its legality focusing on a possible violation of the right of defense of the accused and due process. The research has a qualitative approach, which will allow us to know this environment and identify the considerations that our research subjects have on the right of defense and due process in the Special Process contained in The TUO of Law 30364. Finally, it should be noted that, for the present research, different opinions and approaches of lawyers, legal specialists, in addition to the documentary analysis of different normative bodies complementary to the law in question and the analysis of jurisprudence provided by the Constitutional Court, which jointly was able to determine the causes for which the right of defense of the accused and due process are not affected by the issuance of protection measures under the Special Process contained in The TUO of Law 30364.
