The research titled: “The principle of predictability of judicial decisions and the modification of the name change in the Peruvian Civil Code” had the general objective of proposing the modification of article 29 of the Peruvian Civil Code to include concepts and/or parameters regarding the justified reasons, as well as the numerus apertus assumptions that must be considered by judges when resolving name change requests, in order to guarantee the predictability of judicial decisions. To achieve this objective, name change requests were analyzed, as well as sentences issued by the civil judges of the Superior Court of Justice of La Libertad during the period 2015-2017; Surveys conducted with judges, trial lawyers and university professors in the city of Trujillo were also analyzed. The instruments applied were the documentary analysis sheet and the questionnaire respectively. The results confirmed that there are contradictory sentences among judges, due to the lack of uniform and defined criteria among them regarding "justified reasons." In addition, the surveys reflected a trend towards the need to more precisely define the term “justified reasons” in order to improve clarity in the wording of the standard. The investigation concluded that the proposed modification of article 29 of the Peruvian Civil Code is essential to guarantee the predictability of judicial decisions in cases of name change. The inclusion of clear concepts and parameters will allow judges to have objective criteria when resolving name change requests, thus avoiding arbitrariness and ensuring consistency in the application of the rule.
